Disputing Fault for a Slip and Fall at a Kohls Store

After traffic accidents, slips and falls are the most common types of accidents. Many of these accidents don’t cause serious injuries, but when they do, it can be a financial burden and prevent someone from going back to work. Slip and fall accidents are common in Kohls, or other stores and supermarkets, especially when something gets spilled on to the ground and isn’t cleared up as soon as it should. How to Show Store or Supermarket Negligence Caused a Slip and Fall

To show that the Kohls store (or other store or supermarket) management or employees were at fault, you must be able to show that the hazard, whatever it was, was known about, but not dealt with in sufficient time. For example, if something had rolled on to the floor or spilled out from a bottle or another shopper’s cart just before you stepped on it, you would be unlikely to claim that the store was negligent in its response. On the other hand, if the section of floor you slipped on had just been cleaned, but the cleaner(s) had not bothered to put warning signs around to alert customers to a hazard, then this could be grounds for a claim of negligence on the part of management.

Evidence to Show a Slip and Fall was a Supermarket Chain’s Fault

You will need evidence to back up your claim that your injury was the fault of the store or supermarket management or employees. Unless someone working at the floor admits that the hazard had not been dealt with promptly, you may need to rely on eyewitnesses. Fortunately, stores like Kohls usually have plenty of customers in them and you should be able to find an eye witness or two who saw what happened and will provide a statement to confirm your version of events. It would be even better if you find someone who saw the mess on the floor some time previously.

Other useful evidence includes photos of the actual hazard and your injuries. You can take these with most modern cell phones. If you are lucky, there may be video footage taken by a nearby security camera that inadvertently filmed the accident take place. This video footage could be obtained by your lawyer, through issuing a subpoena.
