Do I Have to Pay Medical Bills With My Settlement?

If you have been injured in an accident, when you file a personal injury claim you will need to include your medical expenses in the damages. When you get a judgment or a settlement, the costs of those medical expenses are figured into the value of your claim. Your claim will include compensation for medical bills that you have already paid and a plan for payment for any unpaid medical bills and a plan for paying all future medical expenses that will be needed for care in the future.

Paying Your Medical Expenses

When you get your settlement or judgment, your medical expenses will be figured into that amount. You will have to cover the costs of your medical expenses out of that settlement. If your health insurance has paid toward past medical expenses, they could put a lien on part of your settlement.

Your attorney might have to reach a subrogation agreement with your medical insurer, where an agreement is reached as to how much you will pay them for those expenses that they paid – it can either be some or all of what they paid out. You will need to keep the money paid toward future medical expenses separate. You will not receive any additional funds to cover those costs and you will need to pay those expenses when you need the care or the procedures.

You want to make sure you get a fair settlement that can cover all your medical expenses. You can decline a settlement and your attorney can pursue a larger settlement amount. Your personal injury attorney can help you throughout the claims process and help ensure your medical expenses are paid.

Other Damages

You will receive other damages on top of the medical expenses. Those will be yours to keep. As an example, your pain and suffering damages will be used to compensate you for any pain and suffering. That total is challenging to determine since you cannot put a dollar amount on it.

Usually all your medical expenses are added up and then they are multiplied by a figure ranging from 1 to 5. The multiplier is determined based on the severity of your injuries and how you are affected in the long-term. You can also seek damages for mental anguish, loss of consortium, loss of enjoyment of life, permanent scarring and disfigurement and other losses.
