Help! I Slipped on a Wet Floor at Subway*

Thousands of people go into Subway or any other sub shop for coffee and a healthy meal every day. This means restaurant employees are often run off their feet delivering what the customers want.

Too often, spilt food and drink ends up in the wrong place and customers unexpectedly slip and fall on the wet floor and are injured. These sorts of injuries are often serious and cause financial hardship to the victims. Many of the victims file a personal injury claim to get compensation for an injury that was not their fault.

How a Slip and Fall Accident Could Occur at a Sub Shop

When food and drink are dropped on the floor and restaurant employees have not been paying sufficient attention to the condition of the floor in the restaurant, slip and fall accidents on a wet floor typically take place. The victim may either fall backwards causing serious spinal injuries or fall forwards which could cause traumatic brain injuries if she or he hits the corner of a table or other hard object.

In both situations the victim may require immediate medical treatment. If the injury is serious, a lengthy period off work may be required in order to recover.

Filing a Personal Injury Claim

If you have been injured in a slip and fall on a wet floor in a restaurant you may be entitled to file a PI claim if you know that you did not contribute to the accident in any way. However, you will have to gather together the evidence to prove that the restaurant is to blame for the injury. This may include:

  • photographs of the wet floor;
  • witnesses’ account of the accident;
  • CCTV footage if available;
  • a medical report from your physician;
  • your employer’s estimate of your loss in income.

As soon as you have this information it is time to file the PI claim. You have to be aware that every state sets a statute of limitations for filing a personal injury claim with many having a deadline of 3 years.

As long as you are within this time frame and your claim is not disputed you can expect to receive the full cost of your medical treatment, all your lost income until you can return to work and an amount for your pain and suffering. If the restaurant is shown to be negligent you may get punitive damages as well.

It’s Advisable to Use a Personal Injury Lawyer

Your personal injury claim has a higher chance of being successful if a PI lawyer works on your behalf. The insurer is far more likely to honor a claim when negotiating with your personal injury lawyer than if you try to file the claim on your own. Fill out the Free Case Evaluation today!
