Hit by a Western Express Truck While Merging on a Highway*

If you have had an accident when a Western Express, or any other shipping service, hit you while merging you will be naturally worried about how much it is going to cost you. It’s bad enough having to seek medical treatment and get your car repaired, let alone thinking about how to get the people who caused you so much trouble to come up with sufficient compensation.

In theory, you may have good grounds to file a personal injury claim if you were hit by the truck driver as he or she was merging into your lane. You still have to prove that this is what actually happened and that it was the truck driver’s negligence that caused all your accident.

Injuries Caused by a Shipping Carrier Merging Accident

Merging accidents are quite common and are not necessarily the worst highway accidents as invariably they occur on the side of the vehicle rather than in front. Big trucks can still cause a lot of damage and serious injuries to occupants, especially if the impact is on the side of the driver. It is hard to be certain what injuries are likely to occur as the number of variables is quite high and every accident has a unique set of circumstances.

The worst case scenario is if the truck that hits you is traveling so fast that it actually causes your vehicle to roll over in the path of other fast moving vehicles. Injuries from such an event could be certainly very serious with broken bones, internal injuries and brain or spinal injuries all possible.

The Process for Filing a Personal Injury Claim After an Accident with a Shipping Truck

Any attempt at filing a personal injury claim must be accompanied by evidence of who was at fault and that negligence on the part of the driver or the company itself was responsible for the damage to your vehicle and your injuries. You will have to find out whether you file your claim with the driver’s insurer or with the company’s insurer or claim against both these two parties.

Evidence of liability can come from a combination of sources:

  • eye witness statements;
  • police accident report made at the accident scene;
  • damage report from the car repair yard you take your car to or is towed to;
  • photographic evidence taken at the accident scene.

Finding Help with Your Claim

Initiating a claim for compensation can seem just too hard when you are trying to cope with the aftermath of a frightening and damaging accident. It is sensible to leave the negotiations with a personal injury lawyer.
